Job description
The Healthcare General Legal Counsel is responsible for developing the infrastructure and managing all issues and any other legal affairs of a major medical group in Fremont, California, just north of San Jose. The right candidate will have experience as a Healthcare Attorney for at least 6+ years with hands-on experience representing medical group PSAs, general healthcare cases, including risk and compliance and employment state laws and trends (wrongful termination, discrimination and wage and hour matters). Solid law school and professional credentials are required.
RESPONSIBILITIES:
- Manages all healthcare, legal, business, and corporate affairs of the medical group.
- Manages the Professional Services Agreements (PSA) between the Medical Group and its foundation and any other agreements that the medical group may have.
- Develops and presents legal advice and opinions relative to the medical group's regulatory requirements.
- Provides guidance and oversight legal issues that arise from the employer/employee relationship.
- To the extent necessary, partner with a third-party legal firm for complex medical group related issues.
- Provides day to day legal advice on a wide range of health care, corporate, and other legal issues, including issues specific to physician groups and physician practice.
- Conducts legal research, prepares legal documents and recommends courses of action to ensure appropriate compliance with existing laws, regulations, and accreditation standards.
- Provides advice and drafting assistance on policies and procedures, and on proposed communications that may have legal implications.
- Reviews and advises medical group on relevant new and proposed statutes, regulations, and judicial decisions affecting the medical group.
- Provides negotiation assistance, reviews, develops, drafts, and prepares contracts with organizations with which the medical group conducts business.
- Monitors, manages, and reviews all work and expenditures for outside counsel to ensure the quality and efficacy of legal services.
- Provides and contributes to educational programs for clinicians and other employees on legal issues pertaining to the medical group.
- Advising on all aspects of US healthcare laws and regulations, state laws, and trends
- Reviews and ensures compliance of all corporate and employment plan documents.
- Oversight of Risk and Compliance for the medical group
- Review Compliance policies and procedures to identify areas of improvement
- Tracks all pertinent issues for the medical group to resolution and completion.
- Participate in the PSA negotiations of the medical group.
- Prepares PSA documents (including amendments) and any other relevant agreements.
- Participate in strategic meetings and discussions about the division as needed.
- In partnership with Manager, HR Business Partner and Chief, Professional Affairs provides oversight of employment investigations, employee counseling, and execution of provider corrective action processes
- Assess/address physician or clinician code of conduct issues in a timely manner, involve CAO/COO, Chief of Professional Affairs, and Manager, HR Business Partner for any employment or corrective action process or discussions.
- Participate in “Strategic Priority” initiatives and committees comprised of all members of the management team to address some organizational needs. Attend periodic board and committee meetings as requested.
Job Type: Full-time
Pay: $180,000.00 - $220,000.00 per year

Education:
- Doctorate (Required)
Experience:
- attorney: 6 years (Required)
- Healthcare Law: 2 years (Required)
