What is the McCloud case
When the Government introduced reforms to public sector pension scheme in 2014 and 2015, they included protections for members approaching retirement; known as transitional protection. A case for unlawful discrimination due to age was brought by member of the Judges’ and Firefighters’ Pension scheme, which was upheld by the Court of Appeal in December 2018; these cases are known as the McCloud case and the Sergeant case respectively. This ruling is colloquially known as the “McCloud Judgement”. The government has confirmed that there will be changes to all main public sector schemes to remove this age discrimination.
