A Legal Assistant is required for the Commercial Litigation team to assist the debt recovery team in securing repayment of unpaid debt from a range of departments across the organisation. A Legal Assistant is required for the Commercial Litigation team to assist the debt recovery team in securing repayment of unpaid debt from a range of departments across the organisation. Principal Accountabilities and Responsibilities:
- Be responsible for a caseload of Debt Recovery matters as well as attending Court for certain hearings. The post holder to prepare such cases for hearing subject to supervision
- Assist the Lawyer and Senior Lawyer in the preparation of debt recovery cases including drafting settlement agreements, witness statements, preparing brief to counsel and applications to the County Court and Court of Protection
- Conducting searches of the Probate registry, Land Registry, Office of the Public Guardian. Placing and removing charges against debtor’s property
- Attend court as advocate in straightforward applications before the District Judges e.g. charging orders
- Prepare bundles for court hearings in accordance with Practice Directions issued from time to time
- Take notes at hearings and conferences with Counsel
- Participate fully in the Debt Recovery Team and to assist and support the lawyers and any other member of the team as required
- Attend to the post holders own day to day administrative work and maintain appropriate records
- Keep up to date with new and proposed legislation, new cases, and other developments and to review and give basic advice as required
- Keep the Senior Lawyer and Lawyer informed of any important issues arising which may affect the satisfactory progress of the cases
- Carry out duties with due regard to the Customer Care, Equal Opportunities, Information Governance, Data Protection and Health and Safety policies and procedures
- Undertake any other duties commensurate with the general level of responsibility of this post
- Law Degree or equivalent experience of working in a legal environment
- Knowledge of the law and practice relating to Probate, Community Care Fees (Care Act 2014 and previous legislation), Debt Recovery in general (essential)
- Knowledge in an area of debt recovery such as Housing Benefit Overpayments, Council Tax Arrears or Sundry Debts from a Local Authority point of view (desirable)
- At least 1 year experience of running a moderate personal case load which involved filing, preparing documents and using IT systems as well as
- At least 1 year experience of handling probate or debt recovery matters or other similar case processing work
- Good presentation skills, including the ability to communicate clearly and concisely in writing and orally
- Ability to provide services in a manner which is consistent with the equal opportunities policies
- Accurate data entry skills
- Good organisational skills
- Ability to prepare cases for hearings and to process a caseload of debt-related work
- Ability to undertake routine litigation
- Ability to prepare cases for hearings

- Ability to analyse information, evaluate evidence, solve problems and present solutions at an appropriate level
- Ability to provide advice and present arguments in a confident, articulate and persuasive manner
- Ability to develop and maintain good working relations with clients
- Highly proficient in MS Word, Outlook and Excel as well as case management and time recording software
