Purpose:

We are seeking a passionate individual to join this team in the role of Data Privacy Advisor. Reporting to the Head of Data Privacy Legal, the role holder is expected to help lead on building a global privacy programme and advising on data privacy law. A legal or data privacy qualification is highly desirable.

The role holder will sit in the business directly, but with the full support of the wider HSBC Legal team.

This is an applied role and will help give birth to a whole new product. The successful candidate will have expertise in either UK and EU data privacy law, or data privacy law in an APAC jurisdiction. The candidate should also be happy to draft key privacy documents, such as DPIAs and privacy notices, and be comfortable directly helping the business navigate new commercial opportunities and innovative technologies.

In this role you will:

  • Support to the new business on the review of new uses of data and provide a steer about how to mitigate privacy risks.
  • Provide advice and guidance on all aspects of privacy risk in respect of building, launching, marketing and operating wallet and payment apps into multiple markets. Ability to help source and present advice from others (e.g. external counsel) where outside direct experience is essential.
  • Draft notices, consent solutions; DPIAs, TIAs and other essential privacy documentation.
  • Liaise with legal, risk and compliance and other colleagues to help ensure that the new business meets all applicable requirements in a global context.
  • Help define and embed risk policy and minimum control standards for privacy risk, with regular engagement with the business and wider HSBC risk, data privacy and legal functions, to ensure the control environment pertaining to privacy risk is suitably robust and fit for purpose within risk appetite.
  • Build, own and maintain strong relationships internally within the business, in particular with commercial, marketing, technology and regulatory personnel.
  • Build and maintain external relationships with third parties, including external advisors, regulators and industry forums where appropriate.
  • Engaging with the wider data privacy, legal and risk community within HSBC.
  • Supporting the Head of Data Privacy Legal and the General Counsel with matters pertaining to wider data privacy risk where appropriate.
Requirements
To be successful in this role you should possess the following:

  • Legal and practical knowledge in data privacy (in either the UK and EU, or an APAC jurisdiction), with bonus points for experience with global retail banking including multi-currency operations, payment and cross border transactions, as well as digital banking models and digital wallets. Knowledge of adjacent laws such as payments, marketing, commercial contract negotiation, etc. also helpful (there are plenty of opportunities to ‘get involved’) but not essential.
  • Ability to proactively identify and address data privacy risks, requirements and issues associated with the business, also drawing on experience within the data privacy, legal and other functions of HSBC.
  • Excellent technical skills, people skills, legal matter management skills and a “can-do” attitude and a hands-on approach. This will be very client facing and you will be expected to own and drive delivery of data privacy compliance, and be an active partner in helping the business achieve good business outcomes.
  • Ability to develop and present balanced recommendations to facilitate decision making to support the business. Not shy of using the tools at your disposal to help facilitate business outcomes and manage risk.
  • Organised and happy to adopt technology to support your work where appropriate.

The base location for this role can be either Leeds, London or Hong Kong (hybrid work arrangement with 3 days per week in the office). Occasional international travel may be required.
