Job description – Proceeds of Crime (“POC”) Paralegal
Salary - London - £31,000 - £51,700
The team
The Legal Division together with Enforcement & Market Oversight (EMO) is responsible for the FCA's responsibilities for market monitoring, delivery of the functions of the UK Listing Authority (UKLA) and the investigation and prosecution of misconduct pursuing and remedying misconduct using the whole spectrum of criminal, civil and administrative sanctions and remedies against firms and individuals. The division aims to:
  • Be a world leading function, with professional and motivated staff, taking the right cases that have a positive impact on the way financial services work
  • Promote the conduct that supports trusted, orderly and efficient primary and secondary markets
Enforcement conducts forensic investigations into suspected misconduct and, where appropriate, pursues and remedies misconduct by firms and individuals through criminal, civil and administrative sanctions and orders including:
  • Bringing criminal prosecutions and seeking penalties to deter misconduct
  • Applying for civil orders to provide an appropriate degree of protection for consumers
  • Requiring compensation to redress the consequences of misconduct, where appropriate
The Criminal Prosecutions Team, housed within the Legal Division, provides advice and conducts litigation in respect of criminal investigations and prosecutions. Within the Criminal Prosecutions Team there is a cadre of lawyers (the Proceeds of Crime Lawyers) who provide legal and strategic advice and conduct civil and criminal litigation under the Proceeds of Crime Act 2002 and associated legislation. Whilst most of these cases are linked to the criminal investigations/ proceedings, some are “stand alone” civil investigations and proceedings.
What will you be doing
Working with the Proceeds of Crime Lawyers you will provide paralegal support across all aspects of our work under the Proceeds of Crime Act 2002 and associated legislation, including applications for investigatory orders, restraint and confiscation orders, civil recovery, enforcement, and ancillary proceedings such as committals to prison for contempt of court etc. As a POC Paralegal you will, for example:
  • Provide paralegal assistance to the Proceeds of Crime Lawyers in conducting civil and criminal litigation before a variety of courts, including the Crown Court, High Court and Court of Appeal
  • Assist with the conduct of litigation, including by drafting routine correspondence, undertaking ad hoc legal research, preparing court bundles, attending court and preparing accurate and concise attendance notes
  • Liaise with external stakeholders such as the courts and counsel as well as applying to register / remove property restrictions held at HM Land Registry
  • Assist in the internal management and record keeping of the Proceeds of Crime Lawyers, including by preparing key points from internal meetings and monitoring less active cases
  • Maintain and promote effective working relationships with colleagues in other business areas (for example the Accredited Financial Investigators)

The skills and experience you will have
Minimum criteria
