Legal Counsel
The responsibility of the Legal function is to provide comprehensive, expert legal and associated tactical/strategic/commercial/operational advice, direction and guidance to BMW Group UK (and as required BMW Group worldwide), its entities, directors, management and employees on business critical, high value, high risk, strategic, corporate, compliance, governance, regulatory, public, reputational, litigation and day-to-day matters; actively identify and advise upon any areas of legal risk and non-compliance to BMW Group; protect, represent and maintain the wider interests and strategic objectives of BMW Group with professional integrity and independent of local interests or influence; including conduct of significant, high-value and/or strategic litigation/disputes; corporate and organisational re-structuring; ensure compliance with applicable legal/regulatory obligations; draft, negotiate, advise and make decisions in relation to commercial arrangements; identify and provide appropriate training and legal updates so as to ensure compliance with and awareness of legal obligations; manage, direct and control external legal advisers/solicitors/counsel, experts, vendors, suppliers and other third parties, including managing and controlling the costs of the same.
Key Responsibilities
- Provide legal advice on consumer credit, FCA regulatory matters and Financial Ombudsman Service complaints.
- Support on multiple commission disclosure claims and complaints made by claims management companies including related county court claims and litigation.
- Proactively identify and advise on potential consumer credit and associated regulatory risks and issues.
- Support to the business regarding regulated product lifecycle, development, distribution/sales channel, customer documentation and customer journey.
- Support with FCA Handbook queries and working closely with the Compliance team.
- In collaboration with the relevant business areas, work to achieve continuous improvement of regulated agreements, policies and processes to ensure customer needs are met.
- Support and advise the business regarding relationships with intermediaries (brokers and dealers).
- Provide input on regulatory aspects of commercial agreements.
- Review financial promotions to ensure FCA regulatory compliance.
- University degree (honours) and one year post graduate legal qualification (Legal Practice Course, Bar Practitioners Training Course or equivalent), including, as appropriate, compulsory post LPC completion of Law Societys Professional Skills Course and Law Societys Management Stages 1 and 2. Successful completion of two year training contract and admission to the Roll of Solicitors and/or successful completion of one year pupillage and call to the Bar with evidence of compulsory accredited continuing professional development, with renewal of practising certificate/s annually.
- Continuing compliance with SRA/Bar Council Code of Conduct, in particular in relation to professional conduct, ethics and client care and the SRAs/Bar Councils continuing professional development requirements and eligible to be authorised to practice and be admitted to the Roll as a solicitor of the Senior Courts of England and Wales and/or entitled to practice as a Barrister.
- 2-4 years post qualification experience in financial services. Majority obtained at a leading private practice law firm or as an in-house lawyer operating at a junior to middle management level with a proven ability to influence and communicate effectively; with demonstrable leadership experience; the ability to establish and maintain strong and effective working relationships with internal and external contacts; good knowledge of the Consumer Credit Act, the FCA handbook, particularly CONC, the ASA and consumer credit issues generally; commercial contract skills; and some experience of contentious matters would be beneficial.

- Teamwork works outside of personal specialism to contribute to development of AJ-UK team including to resources and tools which will benefit the whole AJ-UK teams ability to deliver better legal services to BMW Group UK.
- Legal operations and technology considers and contributes to the way legal services may be delivered more efficiently and effectively to the internal clients; considers process efficiencies and viability of alternative methods of service delivery.
