About the role
What you need to know:
Personal Insurance lawyer reporting to Head of Personal Insurance Legal
Legal Counsel is an integral member of the UK based legal team and required to provide day-to-day legal support to the UK and EMEA Personal Insurance functions working with other core functions as required to advise on direct/indirect insurance distribution models, transactional legal issues, including party to party negotiations, drafting and reviewing legal and policy documentation. Also providing regulatory advice and supporting the implementation of FCA requirements. Responsibility for driving operational efficiency whilst effectively managing legal and regulatory risk. Also working with country counsel to provide legal advice and support to country business/product teams and proactively supporting country counsel by providing specialist personal insurance legal expertise. Based in Fenchurch Street London.
Areas of responsibility include:
(1) Product/Customer documentation: Product related advice (in particular A&H, Yachts, and Warranty Service Programs), drafting and reviewing standard and bespoke wordings, policy endorsements, product development, product sign off, consideration of coverage issues, ensuring compliance with legal and regulatory requirements, adherence to FCA and other regulatory requirements, Product Oversight Governance, adherence to AIG policies and best practices, approval of online sales journeys, websites, marketing literature / promotions, sales scripts, customer letters, including in relation to escalated complaints as appropriate. Experience should ideally include working with GI personal insurance wordings/products.
(2) Distribution: Drafting and review of distribution agreements and associated advice (including UK and/or multi-jurisdictional DUA, TOBA, Facility and Fee for Service agreements, Claims Handling Agreements etc), adherence to legal and regulatory requirements and associated advice on agency, group structures and other distribution issues including direct marketing advice, licensing requirements, product oversight governance, remuneration structures and governance and associated areas of law (Conflicts of interest, Fair Value regulations, Consumer Duty etc)..
(3) Supporting the development and review of precedent documents, know-how and guidance.
(4) Attendance at client / legal counterparty meetings, as required.
(5) Operate within AIG policies standards and procedures.
(6) Provide weekly updates to Head of Personal Insurance Legal.
(7) Advising on non-claims disputes as required; working with claims and the complaints teams on coverage related matters as required.
(8) Managing external counsel and controlling legal spend, driving effective panel management and utilisation and proactively identifying opportunities for operational efficiencies.
What we’re looking for:
Optional areas of experience: (1) FCA/Regulatory; Advice relating to FCA rules and other requirements and implementation of the same; (2) Experience in insurance laws and regulations outside the UK, including the EU Freedom of services/Freedom of Establishment regimes.
